Refunds and Cancellations:

The short version:

Data Choices wants you to be happy with your order. We will work hard and try to exceed your expectations! We provide a service, not a product. Just as you cannot spend weeks and months talking to a psychiatrist and later decide to 'give the service back,' so it is with Data Choices services. The intense service related work is done, and the time spent cannot be returned. However, if you are dissatisfied for any reason we will work hard to alleviate your concerns. And there are certainly instances where we can offer a full refund in the first few days after you order the service; if it is not what you thought it was. For instance, Data Choices does not make the actual changes to your website; we suggest changes for you or your web hosting service to make. (Unless Data Choices hosts your domain in which case we are more than happy to make the changes ourselves!) If you ordered one of our SEO services, thinking we would make META tag changes and content changes to your website, and then learn that we do not, we would like to issue you a full refund. First you should know that your credit card is not charged until a specialist is assigned to your case. Once that specialist is assigned and your credit card is charged we allow you three days to request a full refund. After that period we will have spent significant time and resources which cannot be "undone." If you have concerns after this three day period please contact us so that we may attempt to resolve the issue.

The long version:

If your product or service has recurring fees (monthly, quarterly, annually or otherwise) then you must contact customer support via our online form at least five business days prior to the scheduled date on which the charge is to renew in order to cancel and not be charged for the next period of service.

Most services we provide require intense work that cannot be recouped and most work starts same day or next business day. Because of this cancellations for the initial product or service are only permitted in the three calendar days following the initial purchase in order to receive a full refund. Partial refunds are not authorized for package services that do not have a recurring fee. Partial refunds may be authorized for services that are ordered which do have a regularly recurring fee if the first (primary) service period has elapsed and been paid in full and the customer is requesting to cancel a second or later service period and the customer was unable to reach Data Choices via our online form due to technical difficulties with the Data Choices web server that were beyond the customer's control. The customer must still make an in writing cancellation request and send it USPS mail to: Data Choices LLC, POB 258, Coeur d'Alene, ID 83816-0258, The letter must be postmarked at least five business days prior to the date the customer was charged for the recurring service in order to receive credit.

Custom software solutions are typically accompanied by a 'Scope of Project' report and any such report should clearly indicate whether all, some or none of the projects estimated cost will be refundable. In the lack of a specific Scope of Project report which outlines amounts that may be refundable all work is presumed to be AS IS and payable in full within thirty calendar days of work completion.

Information Collection and Use
General
Data Choices LLC takes privacy concerns seriously.  We do not sell our customer lists to third parties.  We also attempt to associate with reputable
businesses that have and publish their own privacy policies.  Data Choices LLC cannot, however, be responsible for the manner in which other
companies conduct their business.  We encourage you to investigate the privacy policies of any third parties that do business with Data Choices LLC.  
These parties may include but are not limited to:  credit card authorization agencies, merchant services institutes, third party server hosting companies and
other contractors and sub-contractors used by Data Choices LLC which may vary depending upon the products or services that you purchase.

•        Data Choices LLC collects personal information when you register with Data Choices LLC, purchase products from Data Choices LLC or
its suppliers or visit the Data Choices LLC website currently at www.datachoices.com.  This information may be used to assist us in marketing to
specific demographics and to improve our products and services, as well as other operational activities as directed by the Data Choices LLC executive
team. We do not sell our customer lists to third parties.
•        When you register we may ask for information such as your name, email address, mailing address, zip code, occupation, industry, and information about your computer such as its operating system, memory, free space available on the hard drive and other information that may aid technical support with any problems that you may encounter when utilizing our products or services.   
•        Data Choices LLC collects information about your transactions with us and with some of our business partners, including information about your
use of our products and services and feedback that you may provide about such products and services.   
•        Data Choices LLC automatically receives and records information on server logs from your browser, including your IP address, cookie
information, and the page you request. Additionally, the third party service that hosts the Data Choices LLC website may obtain this information and
additional information depending upon their policies.  Currently Data Choices LLC has its website hosted through Yahoo! Business Services.  Google merchant services, Paypal and other providers of merchant services may be used in order to efficiently process customer's orders. These companies automatically collect order information in order to complete the order and help prevent fraud. Their use of the data and their privacy policies vary and may or may not be consistent with the Data Choices LLC privacy policy as they have the right to establish their own policies. The customer is encouraged to read and review the privacy policies of any third party merchant service that is used as a gateway to process the customer's information for Data Choices LLC in order to fulfil said order.
•        Data Choices LLC uses information for the following general purposes: to customize the advertising and content you see, fulfill your requests for
products and services, improve our products and services, contact you, provide technical support, conduct research, and conduct internal audits for
financial and marketing purposes.   
Information Sharing and Disclosure
•        Data Choices LLC does not rent, sell, or share personal information about you with nonaffiliated companies or any nonaffiliated contractor or nonaffiliated sub-contractor except to provide products or services you've requested, when we have your permission, or under the following circumstances:
o        We respond to subpoenas, court orders, or legal process, or to establish or exercise our legal rights or  
    defend against legal claims;
o        We believe it is necessary to share information in order to investigate, prevent, or take action regarding illegal
    activities, suspected fraud or software piracy, or other violations of Data Choices LLC’s software licensing
    agreements or as otherwise required by law.

Placing an order through the www.datachoices.com website is a statement to Data Choices LLC that you agree to have the order placed through the third party (or parties) that we have chosen to utilize for payment processing purposes. By placing the order it is also a statement from you, the customer, that you agree to the terms of use and privacy policies of these third party companies and that Data Choices LLC may share information with these third parties in order to complete an order for any product or service that you have ordered and to continue to share information as needed in order to support these products or services. Additionally you agree that if you ordered any promotional services, similar to the RankMaster Search Engine Optimization (SEO) package, that you consent to the advertising of your website in general, the URL's that you submit, the search terms that you submit and any email address that you have used for the purpose of the SEO package. If you wish to set up a specific email address to handle SEO requests you must contact Data Choices LLC via its support form and specify the address to be used.

•        We limit access to personal information about you to employees who we believe reasonably need to come into contact with that information to

Data Choices LLC operates this Site to provide online access to information about its products and services. By accessing and using this Site, you agree to each of the terms and conditions set forth herein (“Terms of Use”). These Terms of Use are referred to as this “Agreement.”

Definitions

SEO refers to search engine optimization, the service provided by Data Choices LLC when you order any of the listed packages such as the RankMaster Package for three month service, the Charge Ahead Package for six month service, the Domain Pro Package for nine month service or the Domain Pro Supersaver Package for one year of services.

Analysis refers to the examination of web pages, companies, products or services or other factors that may alter a companies' listing on the search engine results page. Analysis is an opinion and is not guaranteed accurate. "Suggestions for optimization" are opinions derived from this analysis and are also only opinions and not guaranteed accurate.

Link Requests refers to a request sent to another company to link back to the requestor's website. Data Choices will only make link requests to companies that do not charge a fee for linking. You may be advised of sites by Data Choices that you may wish to make a link request to. That site may require a fee to be paid. If the site requires any fees you are solely responsible for paying those fees if you choose to make a link request to that company.

Use of Site

You may use the Service, the Site, and the information, writings, images and/or other works that you see, hear or otherwise experience on the Site (singly or collectively, the “Content”) solely for your non-commercial, personal purposes and/or to learn about Data Choices LLC products and services. Password Security

If you utilize a product or service that requires you to log in with a user name and password you are responsible for maintaining the confidentiality of your member identification and password information, and for restricting access to your computer. You agree to accept responsibility for all activities that occur under your member identification and password.

General Provisions

Entire Agreement/No Waiver. These Terms of Use constitute the entire agreement of the parties with respect to the subject matter hereof. No waiver by Data Choices LLC of any breach or default hereunder shall be deemed to be a waiver of any preceding or subsequent breach or default.

Correction of Errors and Inaccuracies. The Content may contain typographical errors or other errors or inaccuracies and may not be complete or current. Data Choices LLC therefore reserves the right to correct any errors, inaccuracies or omissions and to change or update the Content at any time without prior notice. Data Choices LLC does not, however, guarantee that any errors, inaccuracies or omissions will be corrected.

Survivability. If any part of this Agreement is determined by a court of competent jurisdiction to be invalid or unenforceable, it will not impact any other provision of this Agreement, all of which will remain in full force and effect. Any and all disputes relating to this Agreement, Data Choices LLC’s Privacy Policy, your use of the Site, any other Data Choices LLC web site, products, services or Content are governed by, and will be interpreted in accordance with, the laws of the State of Idaho, without regard to any conflict of laws or provisions.
